हमने ध्वनि प्रदूषण के लिए कई जगह शिकायत कर रखी है सीएम विंडो ,सीपीग्राम, प्रदूषण डिपार्टमेंट ,नगर निगम फरीदाबाद ,प्रेसिडेंट secretariat 6 महीने से ऊपर हो गए हैं पर कहीं कोई निष्कर्ष नहीं निकलता न्याय मिलना बहुत मुश्किल है कोई सरकारी डिपार्टमेंट कुछ नहीं करता सरकारी अधिकारी कोई एक्शन नहीं लेते

श्रीमान अधिकारी साहब, मेरा मकान अहमदाबाद के नेहरू नगर, कुबेर नगर, विस्तार में है जहां पर ज्यादा तर मजदूर बस्ती रहती है लेकिन आए दिन हमारे यहां की बस्ती में विवाह समारोह होता रहता है लेकिन उसकी वजह से रात देर तक 12 बजे यां एक दो बजे तक भी तेज आवाज में गाना बजाने का शोर होता रहता है जिससे साधारण लोगों का जीना हराम हो जाता है, कोई बीमार व्यक्ति 8 घंटे का आराम भी नहीं कर पाता कृपा कर के एक pcr वैन रोज 11_12 के आस पास नेहरू नगर में राउंड पे भेजी जाए ता की ऐसी आवाजे बंद कराई जा सकें।आपका बहुत बहुत धन्यवाद

Noise pollution is something that is regulated by various laws. Religious institutions are allowed to use loud speakers according to State laws only between 10pm and 12am, for a time period not exceeding 15 days only during cultural festivals. Otherwise, noise level at the boundary of the public place where a loud speaker is being used cannot exceed 10 dB (A) above the ambient noise standards for the area or 75 dB (A) whichever is lower.
The Indian Penal Code considers such actions public nuisance (Section 268, IPC, 1860) and one can approach the police for help and lodge a complaint. One can also complaint in their state pollution control board to ask for a remedy.
Under Art 25 of the Indian Constitution, right to religion is guaranteed but there may be reasonable restrictions. Since, this noise is harming the public at large and one’s Right to life and liberty (Art 21) is being hampered, it can be restricted.
If nothing works a writ petition can be filed at the High Court of your state. However, it would be better to try to get relief from the other remedies first. Even before that talk with the members of the institution, explain the problems and urge them to reduce volume.

The tort of a private nuisance has been committed for which the aggrieved party should send a legal notice stating the grievances, if it is not acknowledged by neighbours then we can file a civil suit and claim damages for mental distress suffered and we can plead an order of injunction from the recognized court. Further, they should be instructed by the higher authority about the decibel limit and reasonable time one should adopt for carrying out such acts.

Pehla kadam hai ki aapko factory ko ek kanuni notice bhejna hoga jismein likha hua ho ki agar woh factory operation ke dauran paida hone wale shor ko niyantrit karne mein aapki maang ka palan nahi karta, toh is par kanuni karyawahi ki jayegi. Agla kadam hoga ek forum chunna aur shikayat darj karna. Aap local police, Central Pollution Control Board, State Pollution Control Board, National Green Tribunal ya fir kisi District Magistrate, Sub-divisional Magistrate ya kisi aur Executive Magistrate ko Section 144 CrPC ke tahat shikayat darj kar sakte hain. Section 144 CrPC ka istemal tab hota hai jab paristhiti insupportable hai aur turant rahat ki maang ki ja rahi hai.
Public Nuisance ka case bhi kiya ja sakta hai, jismein agar aapko lagta hai ki awaaz se public ko chot, khatra ya pareshani ho rahi hai, toh aap fine tak dandit kiya ja sakta hai. Agar court ki taraf se aapko shor rokne ka adesh diya gaya hai aur aap phir bhi awaaz kar rahe hain, toh aapko 6 mahine tak ki jail aur fine ka dandana hoga.
Environment Pollution Act ke tahat, awaaz pollution ko bhi gambhir roop se liya jata hai. Is apradh ke liye saja ho sakti hai panch varsh tak ki jail aur ya ek lakh tak ka jurmana. Agar shor jari rahe toh aapko prati din ke liye adhik Rs. 5000 ka jurmana bhi ho sakta hai. Agar awaaz pollution ek saal tak bina ruke rahe toh aapko 7 saal tak ki jail bhi ho sakti hai.
Aapke dwara di gayi jaankari ke anusaar, aapko yeh samasya jald se jald local authorities ya kanuni margdarshan ke liye sampark karna chahiye, jisse aapki problem ka samadhan ho sake.

हेलो सर मेरा नाम मोहम्मद सलीम है और मैं टीकर अगचीपुर का रहने वाला हूं मेरे घर के जस्ट बगल में एक चक्की का कारखाना है जिसमें इंजन आईसर का लगा है जिसके कारण बहुत सारी समस्याएं होती है घर वाइब्रेट करता है बहुत ज्यादा ध्वनि प्रदूषण है जब आईसर का इंजन चलता है तो घर की दीवारें हिलती है और सर में बहुत ज्यादा दर्द होता है जिसके कारण घर में कोई रह नहीं पता है उठने बैठने खाने में तकलीफ होती है बात नहीं कर सकते इंजन इतना आवाज करता है बहुत सारी प्रॉब्लम है इंजन के कारण और बीमारी हो रहे सर में दर्द हो जाता है इंजन के कारण बहुत सारी समस्याएं हैं हमारे घर पर हमने थाने में तीन चार रिपोर्ट पहले दिए हैं आज से 4 5 महीना हो गया कोई सुनवाई अभी तक नहीं हुई है हमने 112 को भी कॉल किया है और बहुत सारे एप्लीकेशन भी हुए हैं पर कोई भी सुनवाई नहीं हुई है हमारी कुछ हमारे कुछ मदद करें इंजन को हटाए साउंड पॉल्यूशन बहुत ज्यादा है

ESIC dawakhane ke pass ke chaucasi company ke karan utpann dhvni pradushan ke maamle mein kuch kanooni upaay hain jo samasya ka hal karne mein madadgar ho sakte hain. Sabse pehle, sthaaniya adhikaariyon ko dhvni pradushan ke khilaaf shikayat darj karne chahiye. Shikayat ko tezi se sunvaai ki jaani chahiye aur company ko kanooni taur par utpaadit prabandhan karyavahi ke liye prerit kiya jaana chahiye.
Agar sthaaniya adhikaariyon dwara koi na kriya hoti hai ya samasya ka samadhan nahi hota hai, to shikayat ko pradesh ya raajya ke prashasanik adhikaariyon ya uchch nyayalay tak pahunchaya ja sakta hai. Iske alawa, Pollution Control Board ko bhi samasya ke baare mein suchit kiya ja sakta hai aur unse kanooni karyavahi ki maang ki ja sakti hai.

If any noise is being made which causes you annoyance, discomfort or any injury, then you can file a complaint with the authorities given below. You can also complain if you know that the noise level has exceeded the noise standards by 10 dB(A) in any area or there is noise pollution that happens at night between 10:00 pm and 6:00 am.

Police
You can complain to the nearest police station, call 100 or file an online complaint with your State’s police complaint portal if you want to prevent noise pollution. The officer in charge of the police station, police commissioner or any officer (not below the rank of Deputy Superintendent of Police) can take action by:

Seizing equipment,
Stopping the use of a microphone or loudspeaker, etc.
Going to the Pollution Control Board and getting a written order prohibiting the noise.
Central and State Pollution Control Board
The Central Pollution Control Board (CPCB) provides technical services to the Ministry of Environment and Forests for implementation of the provisions of the Environment (Protection) Act, 1986. Its main functions are to promote cleanliness of water in streams, wells, etc. and prevent water pollution. The Board also has the duty to improve the quality of air by preventing air and noise pollution. The Head Office of the CPCB is in New Delhi and they also have several regional offices across states.

Even though the offices of the CPCB are only there in a few states, every state also has an office known as the State Pollution Control Board (SPCB). You can also approach the SPCB offices to file a complaint. These authorities have the power to issue a written order for preventing, prohibiting, controlling or regulating:

Any vocal or instrumental music
Sounds caused by playing, beating, clashing, blowing
Instruments including loudspeakers, public address systems, horn, construction equipment, appliance or apparatus which is capable of producing or reproducing sound
Sounds caused by bursting of sound emitting fire crackers
Sounds caused from a business operation, or trade, for example, business of manufacture of utensils, etc.
The authorities may give an opportunity to the person who made the noise to be heard and then may modify or alter the order.

Courts
District Magistrate
You can approach the nearest District Magistrate (Court) with the help of a lawyer to complain about noise pollution. The Court has the power to temporarily stop or remove the nuisance caused by noise pollution. The Court may pass the following orders after hearing out the person who caused the noise pollution:

Temporary order or injunction to stop the noise
Order to remove the noise or regulate it
Permanent order to remove the noise pollutant and stop the noise
National Green Tribunal
The National Green Tribunal (NGT) is a specialised judicial body where you can go to file environmental cases including noise pollution cases. The NGT was set up to:
Provide effective and expeditious remedies for environmental protection,
Conservation of forests and other natural resources
Enforcement of any legal right relating to the environment.
The NGT’s orders are binding and it has power to grant relief in the form of compensation to affected persons.

Locations of the Tribunal
The NGT has a presence in five zones – North, Central, East, South and West. The Principal Bench is situated in the North Zone, headquartered in Delhi. The Central zone bench is situated in Bhopal, East zone bench in Kolkata, South zone bench in Chennai and West zone bench in Pune.

Filing a Complaint with the NGT
Any person seeking relief and compensation for environmental damage or pollution involving subjects like air pollution, environment pollution, water pollution, etc. can approach the NGT. The decisions of the NGT are binding and you can appeal within 90 days to the Supreme Court if you are unhappy with its decision.

You can engage a lawyer if you want to approach the Court to file a case or file an appeal from a judgment of a lower Court.

Lekin agar vo kisi normal time par gaane baja rha h toh uske liye apko dekhna padega ki sirf ap hi pareshan ho rhe h ya or log bhi h apke sath jo uss gaane ki vajah se dikkat me h agar or bhi log hai toh ap sb jaake ek warning dilwa sakte h police ke through uss bande ke ghar pr.

AFTER LODGING COMPLAINT REGARDING DJ/LOUDSPEAKER POLICE OFFICIAL INFORMING ME THAT ” मैडम ब्याह शादी में तो बजाएंगे” when I interrupted him that beyond 10 PM , he again arguing that ” आपके नहीं बजता क्या 😀” when I told him that after 10 PM we do not and firstly we do not dare to do such events in streets to disturb anyone. Then he KEPT on intimidating me. This is the situation of INDIAN POLICE OFFICIALS.
SADLY BUT THIS IS THE ONLY TRUTH I HAVE BEEN EXPERIENCING. TOTAL INCOMPETENT PEOPE ARE OCCUPIED ON SUCH A SENSIBLE POSTS. Again disappointed. I have proper recording too.

Ek case tha Church of God (Full Gospel) in India v. K.K.R. Majestic Colony Welfare Assn, jisme supreme court ne he kaha hn ki ” directions in respect of controlling noise pollution, even if such noise was a direct result of and was connected with religious activities. It said, “Undisputedly, no religion prescribes that prayers should be performed by disturbing the peace of others nor does it preach that they should be through voice amplifiers or beating of drums. ”

श्रीमान जी हम राजस्थान के श्री गंगानगर की तहसील सूरतगढ के ग्रामीण इलाके से हैं हमारी समस्या ये है कि यहाँ गावों में शादी ब्याह में लोग कई-कई दिनों तक बहुत देर रात्रि तक ऊंची आवाज़ मे डीजे बजाते हैं जिससे मनोरोगियों अन्य बिमारियों से जूझने वाले मरीजों ,बुजुर्गों व पढ़ने वाले बच्चों को बहुत ही दिक्कत का सामना करना पड़ता है इनको बंद करनें का कहें तो ये लोग लडाई झगड़े पर उतर आते हैं
