बैंकों द्वारा लापरवाही/गलत ढंग से चेक बाउंस करने के मामले भी हो सकते हैं। हो सकता है कि बैंक द्वारा चेक गलत तरीके से बाउंस हो गया हो। यह बैंक की ओर से लापरवाही या गलती के कारण हो सकता है। यह उपभोक्ता कानून में ‘सेवा में कमी’ के अपराध के बराबर है।
अगर आपके द्वारा जारी किए गए चेक के साथ ऐसा हुआ है तो आप बैंक के खिलाफ उपभोक्ता फोरम में केस दर्ज करा सकते हैं।
बैंक अधिकारियों की ओर से चूक या लापरवाही के कारण डिमांड ड्राफ्ट का बाउंस होना जैसे हस्ताक्षर न करना, कोड नंबर का उल्लेख करने में विफलता आदि को भी सेवा में कमी के रूप में माना गया है।

Bank return a cheque with reason exceed arrangement by which a sec 138 N I Act case is lodged against me . I was authorised signatory of cheque of the company which I left before 5 months of cheque bounce.
As bank was already informed 2 months before cheque return by fresh board resolution that I am no more authorised signatory.
Bank confirmed me on RTI that when cheque returned you were not authorised signatory.
But not giving a correct return memo that cheque not signed as per mandate on record instead false reason of Exceed arrangement saying because no balance was in account when cheque presented
As per RBI rule nd section 10 N I Act bank can not pay the cheque even if the account had balance because cheque was not perfectly drawn
Can I file a FIR on bank official who fraudulently return cheque with false reason just for implicate in a criminal case..under breach of trust, cheating, fraud in cheque return memo of forgery.
Because if bank give correct return memo cheque bounce case not sustainable against me.

Section 468 pertains only to the cases where forgery is for cheating. Forgery has been explained before as concerning the presence of one or other of the two elements of dishonesty or fraud.
Proof: the prosecution has to prove that the:
• Accused committed forgery.
• That he did so with the intention that the document forged shall be used for cheating.
Section 465 of the Indian Penal Code deals with the penalty for forgery in India. As per this Section, the offence is punishable by a jail cycle elongating up to 2 years or fine or both. It is a non-cognizable, bailable offence in India that is triable by a Magistrate of the first class.
